The American suffered a horrific car accident in October 2009 from which he was lucky to emerge with his life. He broke his right femur and tibia, left elbow, suffered facial fractures and lacerated his bladder. A 22-year-old passenger in the car with him died.

Remarkably after six corrective surgeries, however, the striker was back in training with his club, Ligue 1 Sochaux. He was loaned out to MLS side DC United for the 2011 season, and has scored 11 goals for the club as his recovery continues.

Two years after the accident, Davies's lawsuit names Das Enterprises, the owner of a nightclub where Davies was on the night of the incident, and Red Bull North America, the host of the event.

The companies are accused of continuing to serve alcohol to Maria Alejandra Espinoza, with the lawsuit claiming she had 'become visibly intoxicated.'

Davies was Espinoza's passenger on the night of the accident. She has since pled guilty to involuntary manslaughter and maiming while driving intoxicated, and is serving a two-year sentence.

It is, however, a crime to serve alcohol to anyone who appears intoxicated, and this is what Davies claims took place.

Despite the 25-year-old continuing to play top level football, his career has not yet scaled the same heights as before the accident. Having played 17 times for the USA before 2009, he has yet to earn a call-up to the national team since, and missed out on a selection for the 2010 World Cup in South Africa, where the USA reached the last 16.​
